1. Acceptance of Terms

By creating an account, downloading the client, or accessing Grow with the Dungeon (“the Service”), you (“you”, “your”, or “user”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

The Service is operated by YSNH Games, a sole proprietorship located in Japan (“we”, “us”, or “our”). The operator’s full legal name and address are not published on this page for privacy and safety reasons. They are available upon written request to grow.w.t.dungeon@gmail.com where required by applicable law or reasonably necessary for privacy-related requests, formal legal notices, regulatory inquiries, dispute resolution, responses to lawful demands by courts or authorities, or other legitimate requests.

2. Description of the Service

Grow with the Dungeon is a free-to-play 2D multiplayer online role-playing game distributed through official distribution pages maintained or designated by YSNH Games (including itch.io where applicable) and operated on servers maintained by YSNH Games.

When you interact with the Service via the itch.io platform — including the project page, the browser HTML5 client, downloadable desktop clients, comments, ratings, favorites, following, or other itch.io-native features — your use of itch.io itself is also subject to itch.io’s own Terms of Service and Community Rules, in addition to these Terms. For interactions inside the game running on our servers (character actions, in-game chat, bulletin posts, moderation, and account operations), these Terms govern.

The Service is provided “as is” with no guarantees of availability, performance, or suitability for any particular purpose. See Sections 9 and 10 for detailed disclaimers.

3. Eligibility

To use the Service, you must:

If you are under the age of majority in your jurisdiction, you affirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not implement a separate guardian-confirmation step within the Service (such as email verification of a parent or guardian, or a dedicated age-gate UI). Eligibility under this Section is based on your attestation at sign-up and your continued use of the Service. If we discover that you have misrepresented your age or your guardian’s approval, we may suspend or terminate your access as described in Section 12 and, where applicable, delete the associated account data in accordance with the Privacy Policy.

4. Account

4.1 Account creation

You create an account by signing in with your Google Account via Google OAuth. You may create up to 4 characters per account. Character names must comply with our naming rules (Section 6).

4.2 Account security

You are responsible for maintaining the security of your Google Account, which is used to access the Service. We are not liable for any loss, damage, or unauthorized access resulting from compromised Google Account credentials.

4.3 One-person-one-account principle

You may only create one account per person. Operating multiple accounts to gain unfair advantages, circumvent bans, or otherwise abuse the Service is prohibited (Section 7).

4.4 Account deletion

You may delete your account at any time through the in-game AccountCenter (“Delete Account” tab). As explained in Privacy Policy Section 5.1, account deletion is only available through this in-game route because we cannot reliably verify your identity from an email address; we do not act on email-based deletion requests. Deletion is irreversible (see Privacy Policy Section 6).

You acknowledge that all in-game items, characters, currency, equipment, and progression data are part of the Service only and have no real-world monetary or property value. They are not “virtual goods” exchangeable for fiat or cryptocurrency, are not legal tender, and confer no ownership rights enforceable outside the Service. Accordingly, you agree not to:

We reserve the right (and may be legally obligated) to report suspected criminal activity to relevant law enforcement authorities and to preserve any associated logs (chat, bulletin, account, and other records — to the extent such logs exist based on enabled features) as evidence for as long as legally required (see Privacy Policy Section 4 — Legal hold exception).

Safety response (self-harm and harm to others): If content posted through the Service suggests an imminent risk of self-harm or harm to others, we may, where reasonably necessary, preserve relevant information, take safety-related actions within the Service (such as removing content or muting a character), and, where appropriate, contact competent authorities or emergency services. These steps are framed as a safety response rather than a sanction against the user, and the related preservation may extend beyond ordinary retention periods as part of the Legal hold exception described in Privacy Policy Section 4.

To ensure effective content moderation by our small operations team, character names and any text submitted through in-game communication features (such as chat messages or bulletin board posts, where such features are enabled on the server) must use English or Japanese.

We welcome players from any country or region who can communicate in these languages. Supported character scripts include: Latin letters and Arabic numerals, common punctuation, hiragana, katakana, and CJK Unified Ideographs (kanji).

Content in other scripts (such as Hangul, Cyrillic, Arabic, Devanagari, Thai, etc.) is not currently supported and will be rejected by the system with a notification message. We may expand supported languages in the future as our moderation capacity grows.

6. Character Names and User-Generated Content

6.1 Character names

6.2 User-generated content (chat, bulletin board, where available)

If the relevant features are enabled on the server, content you create through chat messages, bulletin board posts, or other features:

You are solely responsible for content you create. We are not liable for user-generated content.

7. Enforcement

7.1 Violations

If you violate these Terms, we may, where reasonably necessary to maintain the integrity, safety, lawful operation, and continued availability of the Service for other users, take one or more of the following actions, with or without prior notice. Enforcement actions are organized as a graduated set of measures; we may select the level we consider appropriate for the violation, and are not required to progress through lower tiers before applying a higher one.

All enforcement restrictions listed above (including mute, rename requirement, suspension, and ban) apply on a per-server basis: an action taken on one difficulty server does not affect the same account on another difficulty server. Sign-in to the AccountCenter for the purpose of submitting an appeal (Section 7.3) remains available in all cases.

7.2 Notice of enforcement actions

Where reasonably possible, we will notify you of an enforcement action and provide a general summary of the reason (such as the category of violation). We may, however, withhold detailed information — including but not limited to specific evidence, third-party identities, internal moderation logs, and details whose disclosure could enable circumvention of moderation or expose other users to retaliation — where reasonably necessary to protect other users, prevent further abuse, comply with legal obligations, or maintain the effectiveness of our moderation. We generally aim to act proportionally and transparently within these constraints.

7.3 Appeals

If you believe an enforcement action was made in error, you may submit an appeal through the AccountCenter “Opinion” tab within the Service. To submit an appeal:

  1. Sign in to your account. The AccountCenter remains accessible even if your character is muted, suspended, or banned, or your account is suspended or banned — sign-in to the AccountCenter is allowed for the purpose of submitting appeals
  2. Open the AccountCenter and navigate to the “Opinion” tab
  3. Include in your message:
    • The character name affected by the action (if applicable)
    • A description of the enforcement action you are appealing
    • The reason you believe the action was incorrect

Why the in-game Opinion channel is the only appeal route: Appeals require us to verify that the appeal originated from the actual account owner. The Opinion channel authenticates you through your active sign-in session, which provides this verification automatically. We do not accept appeals through email or other channels, because we do not store the email addresses associated with our users’ sign-in identities and cannot reliably link an email message from an arbitrary address to a specific account. Sending an appeal through any channel other than the in-game Opinion tab will not be acted upon.

Appeals are reviewed on a best-effort basis. Response times may range from several days to several weeks. We are not obligated to reverse any decision.

7.4 Reporting violations

If you observe other players violating these Terms (e.g., harassment, threats, illegal content) — whether in character names, chat or bulletin board posts (where such features are available), or any other communication feature — you may report them through either of the following channels:

For emergencies involving immediate threats to life or safety, please contact local emergency services first (e.g., 110 in Japan, 911 in the US). We are not equipped to respond to real-world emergencies in real time.

We review reports on a best-effort basis. Submitting a report does not guarantee any specific action will be taken. Note that, when the bulletin board feature is enabled, bulletin posts are automatically deleted from the in-game display after 1 day (see Privacy Policy Section 4); time-sensitive reports about bulletin content should be submitted promptly. The underlying chat.log record (which mirrors bulletin posts when applicable) is retained for 365 days for audit purposes.

Misuse of the reporting feature is itself a violation of these Terms. This includes, without limitation: submitting knowingly false or fabricated reports; coordinated mass reporting intended to harass, silence, or retaliate against other players; using the in-game ! report channel for unrelated communication such as casual chat with administrators, advertising, or spam; and weaponizing the report system as part of any harassment campaign. We may take enforcement action — up to and including suspension or ban — against users who misuse the reporting system, in addition to any action taken against the originally reported user.

8. Intellectual Property

The Service is composed of multiple types of content with different ownership and licensing arrangements:

8.1a Notice regarding AI-generated content

You acknowledge that some assets used in the Service are generated by AI tools, and that the legal status of AI-generated content under copyright law is currently evolving and varies by jurisdiction. YSNH Games does not warrant that AI-generated assets are free of all third-party claims. If you believe any asset in the Service infringes your rights, please contact us at grow.w.t.dungeon@gmail.com with sufficient information to identify the asset and the basis of your claim; we will review and, where appropriate, replace or remove the asset.

8.2 Third-party assets and licenses

The Service incorporates third-party assets used under their respective licenses, including:

8.3 Fan content

We generally permit fan content (fan art, fan fiction, streaming, video creation) referencing the Service, provided it does not falsely imply official endorsement and does not contain content that violates Section 5.

We reserve the right to request removal of fan content where reasonably necessary (for example, where the content violates the conditions above, creates user confusion about official endorsement, or raises legal or reputational concerns).

9. Disclaimers

9.1 “As is” basis

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 No guarantee of availability

We do not guarantee that the Service will be available at all times. Server outages, maintenance, network issues, or other circumstances may cause temporary or extended interruptions without prior notice.

9.3 No guarantee of data preservation

While we take reasonable measures to preserve player data, we cannot guarantee that character data, items, currency, or other in-game progress will not be lost due to server crashes, bugs, hardware failures, database corruption, backup failures, save-path defects, file-system errors, recovery operations, server migrations, or other technical issues. Data is saved periodically, typically every 30 minutes; the actual amount of progress lost in any given incident may vary depending on the nature of the incident and the most recent successful save. You acknowledge that in-game progress has no real-world monetary value, and any loss of progress is not a financial loss for which we are liable.

9.4 Player interactions

The Service allows non-combat interactions between players, including:

Direct player-vs-player combat is not implemented; players cannot damage each other. However, we are not responsible for disputes, losses, or harm arising from any player-to-player interactions, including but not limited to: in-game trades, chat conflicts, bulletin board disputes, or off-platform interactions originating from in-game contact.

9.5 User responsibility and in-game risks

You are responsible for familiarizing yourself with the in-game Help panel and these Terms before and during your use of the Service. The Service includes mechanics whose outcomes are irreversible or asymmetric, including (without limitation):

You acknowledge that lack of familiarity with the game’s mechanics, the in-game Help, or these Terms does not entitle you to compensation, item restoration, in-game currency restoration, refunds, or any other remedy.

Where bugs, exploits, or unintended interactions cause loss of in-game progress, we may, at our reasonable discretion and on a best-effort basis, restore affected progress; however, we are under no obligation to do so, and no real-world compensation in any form will be provided in any case (see Sections 5.3, 9.3, 11.3 for the no-real-world-value framework, and Section 10 for the liability cap).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL YSNH GAMES, ITS OPERATOR, OR ANY AFFILIATES BE LIABLE FOR ANY:

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO US for the Service during the 12 months immediately preceding the event giving rise to the claim. While the Service remains free of charge and no payment is made by you, this cap is therefore effectively JPY 0 (zero Japanese yen). If paid features are introduced in the future, this cap will adjust upward according to amounts you have actually paid for those features, subject to the carve-out below.

This cap does not apply, and nothing in these Terms limits our liability, where such limitation is prohibited by applicable law — including but not limited to liability arising from our intentional misconduct or gross negligence, liability for death or personal injury caused by our negligence, and any other liability that cannot lawfully be excluded or limited. In particular, under the Consumer Contract Act of Japan (Act No. 61 of 2000), provisions purporting to exclude all liability of a business operator, or to exclude liability for intentional or grossly negligent acts, are void to that extent.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Changes to the Service

11.1 Updates and modifications

We reserve the right to modify, update, or change the Service at any time, including:

Significant changes will be announced via in-game notifications and our official website, official distribution pages, or official development logs (including the itch.io devlog where applicable). Continued use of the Service after changes constitutes acceptance of the modifications.

11.2 Future monetization

The Service is currently free of charge. We do not currently offer paid features, subscriptions, in-game purchases, donations, or advertising, and have no immediate plans to do so. If this ever changes, we will provide at least 30 days’ advance notice via in-game announcement and our official website, official distribution pages, or official development logs (including the itch.io devlog where applicable), along with additional terms, payment conditions, refund policies, and any legally required disclosures (including but not limited to the Act on Specified Commercial Transactions of Japan, and any applicable disclosures concerning prepaid in-game currency under the Payment Services Act). You may delete your account before any such change takes effect if you object.

No charges will be applied to your account without your explicit, separate consent. Continued use of the free portion of the Service after paid features are introduced does not by itself constitute consent to any paid feature; active acceptance (e.g., a separate click-through agreement or affirmative selection of a paid plan) will be required before any charges are incurred.

If monetization is ever introduced, any pre-existing in-game progress, items, or currency at that time will be retained according to a transition policy announced at that time. No specific commitments are made regarding the form of such transition.

11.3 Service termination

We reserve the right to discontinue the Service at any time, including but not limited to the following circumstances:

You acknowledge and accept that, as a free service with no paid contract, NO COMPENSATION, REFUND, OR TRANSFER will be provided in the event of Service termination, modifications, interruptions, or data loss. This includes any in-game items, currency, character progress, or other digital content.

No character data export is provided. In-game progress data (characters, items, currency, etc.) has no real-world monetary value, no value or utility outside the Service, and is not transferable, refundable, or convertible under any circumstances. We do not export, transfer, or preserve such data beyond what is needed for normal Service operation. You acknowledge that all in-game progress will be permanently and irrecoverably lost upon Service termination.

By using the Service, you accept the inherent risks of using a free game operated by a small indie developer, including the possibility that the Service may not continue indefinitely.

12. Termination of Your Access

We may suspend or terminate your access to the Service where reasonably necessary, including (without limitation): enforcement following a violation or suspected violation of these Terms; protection of the Service, other users, or third parties from security threats, abuse, or harm; compliance with legal obligations, regulatory requirements, or lawful orders; and operational necessity (e.g., responding to incidents that require account-level action). Self-initiated account deletion at your own request is handled separately and follows the procedure described in Privacy Policy Section 6, not this Section. Upon termination under this Section:

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict-of-laws principles.

Any dispute arising out of or related to the Service or these Terms shall be subject to the exclusive jurisdiction of the courts located in Japan, specifically the district court having jurisdiction over the operator’s residence.

If you reside outside Japan, you waive any objection to this jurisdiction and forum.

14. General Provisions

14.1 Entire agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and YSNH Games regarding the Service.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to a successor entity (e.g., in the event of incorporation or acquisition) without your consent.

14.5 No agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and YSNH Games.

14.6 Force majeure

We are not liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, network failures, or other force majeure events.

15. Support and Contact

YSNH Games is operated by a single individual alongside other professional commitments. We cannot guarantee real-time or rapid response to inquiries. Please understand that response times may range from several days to several weeks.

The English version of these Terms of Service is the governing version. A Japanese translation is provided for convenience as a reference translation. In case of any inconsistency between the two versions, the English version prevails.
